This information (together with any information which references it) informs you the customer (“Customer”) of our terms and conditions (“Terms”) on which we supply any of the goods ("Goods") listed on our website  “https://www.airgon.co.uk” ("Website") to you once an order (“Order”) for the Goods list on our Website has been received. Our Website is the property of Airgon Technologies Ltd. Airgon Technologies (“Airgon”) is the trading name of Airgon Technologies Limited, a company registered in England under company number 14104291, whose registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.UK.

Use of this Website is subject to these Terms. If you do not accept these Terms, you are not given authorised to use or continue using this Website.


Delivery

All standard UK delivery is free unless stated. Delivery of the Goods will be to the address given during the ordering process. Any changes to the delivery address after the Order has been acknowledged must be given prior to the Order being dispatched. We must be informed by phone and the request must be confirmed by email. This will be at our discretion. Delivery is to the front door of the property only.

Provided that we deliver the Goods to the address you have specified (or any other address agreed by us in writing or email) then the Goods will be deemed to have been delivered and we will not be liable to you for non-delivery of the Goods. We do not have to satisfy ourselves that the person who accepts delivery at the address you have provided is you (or is a person authorised by you to accept delivery of the Goods).

Goods are only delivered by us or by a third party contracted to undertake delivery on our behalf.


Price on website

All prices are given in GBP and include all taxes at the enforceable VAT rate on the payment date.

We reserve the right to change our prices on our Website at any time. The Customer will be charged the price applicable at the point of Order.

The sale price includes shipping charges, unless stated otherwise. Shipping charges may apply in addition to the price of purchased products, depending on the options chosen by the customer. All costs for Goods and any applicable services will be shown before the registration of the Order by the Customer.


Discount Codes

Discount codes when offered may not be redeemed for Orders that are paid for using credit or monthly repayment offers.  Only one discount code per UK address may be claimed.


Payment Methods

You can pay for your purchase by any means available on the Website at the time of ordering. If the purchase method employs an option to divide the payments for the Airgon into multiples, the organisation with whom credit is requested must accept the request. Airgon has no responsibility or authority over any credit or payment options except for processing payments made in full a given Order. The account associated with your payment method will be charged in accordance with that payment method’s terms and conditions.

Payments made on our Website will be processed by Shopify’s secure 256-bit SSL data encryption. Whilst this is believed to be a highly secure system, Airgon has no control or responsibility over the security provided by Shopify.

The Customer fully authorises Airgon to use the payment card details provided to pay for their Order and that such payment means legally giving access to sufficient funds to cover all costs of the Order on the Website. Airgon cannot be held liable for any fraudulent use of the payment method provided.

Airgon is not responsible for any attempts made to pay by any other means other than those offered on the Website.  We are not liable for loss of payment by any means other than that on the Website (i.e. cheque or cash).

Airgon reserves the right to suspend or cancel any Order and / or delivery, whatever its nature and level of execution in case of non-payment of any sum payable by the customer or incident of payment.

The delivery of any Order may be suspended in case of late payment of a previous order by the same Customer or associate, notwithstanding the provisions hereof.

Airgon retains full ownership of Goods until payment is received in full.


Product Availability

If one or more parts of the Order are not available after placing the Order, the customer will be notified by email or telephone. If the Order cannot be fulfilled in its entirety, the Customer will be notified by email or telephone and any payment transactions will not be charged (or refunded). Airgon cannot be held liable for any loss suffered by the Customer as a result of non-fulfilment, nor liable to any damages.


Product Guarantee and warranty

Our Products are guaranteed for a period of 20-years from the data of purchase subject to registration on the Website using the unique serial number and the required registration criteria being fulfilled.

Your guarantee may be invalidated if you have not taken reasonable care of your Airgon A22 or A54. This guarantee does not apply to instances of accidental damage of any kind including unintentional damage or if the device shows evidence of incorrect installation.
Warranty covers defects in materials and workmanship in a domestic heating system including any manufacturing or workmanship issue with the device.
Any products sold by us through other sales channels such as Amazon, etc, must be registered on our website.

The warranty does not cover;
•    Any damage resulting from non-domestic use for which it was intended with a maximum system pipe size of 28mm.
•    Products sold by resellers who are not authorised retailers.
•    Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased by another consumer.


Returns, Refunds & Exchanges

You have 14 days to return your Airgon. Provided the Airgon is still in it’s original packaging, we may accept a return after 14 days although we will issue a restocking fee. The restocking fee is 15% of the original purchase fee (£37.35).
To start the cancellation process, you must call us and be given a returns number.  We cannot accept the return without this number. For more information on returns visit https://www.airgon.co.uk/help

We cannot accept any returns where the product has been installed, or if it is not in perfect condition with all of the packaging intact. All returns are to be paid by the customer.

Your refund will be made back into the account used for the original purchase when the product has been received by us and our quality control team assesses the products for any damage.

The product must be shipped within 48-hours of informing us of the return by telephone and confirmed with a return number and received by us within a period of 72 hours.  

Please note that it may take up to 14 days for your bank to credit your account. We are not liable, and cannot take responsibility for, any bank charges that you may incur during the refund process.


Intellectual Property

All items displayed on the Website, including but not limited to the copy, reviews, articles, illustrations, images and trademarks are protected for the whole world under copyright and intellectual property. Total or partial reproduction of the items available on the website on any present or future medium is strictly prohibited without expressed permission form the company in writing.


Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our website, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.


Events Beyond our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event").

A Force Majeure Event includes any act, event, non-happening, omission accident or Act of God beyond our reasonable control.

Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.


Amendments to Terms and Conditions

We have the right to revise and amend these Terms and conditions from time to time.


Privacy and security policy

If you wish to make an online purchase from us, then you will be required to provide certain personal information as a necessary prerequisite of being able to place an Order.

Your information will be kept secure. You may contact us at any time for access to your information in order to ensure that the information is correct and up to date.

From time to time, we may use your information for direct marketing purposes linked solely to Airgon Technologies and which we believe are of a legitimate interest to you as the Customer. You are free to opt out of direct marketing at any time by providing written notice of your request to optout@airgon.co.uk.

Any email newsletters can be unsubscribed from at any time within the newsletters themselves.


Other Terms & Conditions

Customers making an Order have read the details of the products listed on the product page or in the Frequently Asked Question page or are deemed to have contacted the customer service if they consider that it lacks any information.

Airgon reserves the right to modify at any time the design, manufacture, materials or any other element of its products and to notify the customer by updating its website. Information on the website the day of the order are those that are binding.

Airgon aims to inform the Customer to enable understanding of the essential characteristics of the product. It is clarified that the photographs, graphics and descriptions of products offered on the Website are indicative and not within the contractual field. Airgon agrees that the photographic representation on the website is as faithful as possible to the products themselves.

All the Products are manufactured to comply with UK laws and regulations

Airgon reserves complete freedom of its offer on the Website. Airgon may change at any time the Products and / or services offered for sale on it’s Website without prior notice or prejudice of Orders already placed by the customer.


Governed by UK law

Contracts for the purchase of goods through our site will be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of the UK.
